A.G. SCHNEIDERMAN ANNOUNCES SETTLEMENT WITH ALLIED WASTE SERVICES FOR FAILURE TO PAY BUFFALO WORKERS LEGAL LIVING WAGE

Attorney General Schneiderman Has Won Back Nearly $30 Million In Stolen Wages For Over 21,000 Workers Across New York

BUFFALO – Attorney General Eric T. Schneiderman today announced a $69,000 settlement with Allied Waste Services of North America, LLC (“Allied”), a commercial waste management company, for failing to pay Buffalo’s living wage to 16 workers at a Buffalo recycling facility. Allied is a subsidiary of Republic Services, Inc., the second largest solid waste management company in the United States.

The Buffalo Living Wage Ordinance requires that employers who contract with the City of Buffalo shall pay no less than a living wage to specific groups of employees, including waste management employees. Allied had entered into a waste management contract with the City of Buffalo for recycling collection and processing from 2012 to 2017. The Attorney General’s investigation, which commenced following the Buffalo Living Wage Commission’s July 2016 determination that Allied was not in compliance with the Living Wage Ordinance, found that Allied failed to pay the living wage of $11.63/hour to 16 employees. Per the settlement, Allied has agreed to pay $69,000 in restitution, which will be distributed to the workers.

“Our living wage laws ensure that employees working on taxpayer-funded public projects are paid a fair wage. Allied attempted to illegally circumvent this rule, ultimately costing hardworking New Yorkers thousands of dollars in wages,” said Attorney General Schneiderman. “Companies that attempt to cheat the system and shortchange employees show a complete lack of respect for workers, and we will continue to ensure that everyone in our state is paid the wage they deserve.”

“The WNYCOSH Worker Center is heartened by this settlement. It means the City of Buffalo Living Wage is working to ensure that workers, working for employers that benefit from city contracts are entitled to be paid a wage that allows them to support their families,” said Brian Brown-Cashdollar, WNYCOSH Worker Center Program Director.

In addition to employing its own workers as recycling sorters, Allied also employed temporary workers through staffing agencies. The Labor Bureau is continuing to investigate the compliance of these staffing agencies with Buffalo’s Living Wage Ordinance.

To date, Attorney General Schneiderman has won back nearly $30 million in stolen wages for over 21,000 workers across New York.

The case was handled by Assistant Attorney General Susan Cameron, under the supervision of Labor Bureau Civil Enforcement Section Chief Mayur Saxena. The Labor Bureau is led by Bureau Chief ReNika Moore and Deputy Bureau Chief Julie Ulmet. The Labor Bureau is part of the Social Justice Division, led by Executive Deputy Attorney General Alvin Bragg.
