Overview of Southerntier settlement

Southerntier is a commercial and industrial fabrication company that employed both union and non-union employees between September 30, 2020 and April 30, 2022. Southerntier had Collective Bargaining Agreements (CBAs) in effect with Local 112 and Local 58 respectively. 

Our investigation found that during this period Southerntier failed to provide paid sick leave or a comparable benefit to its unionized workforce. 

As a result of OAG’s investigation, Southerntier has agreed to pay $148,252.47 into a restitution fund. This money will be sent to current and former Southerntier employees who were part of a CBA between September 30, 2020 and April 30, 2022 and did not accrue paid sick leave and could not use the benefit. 

All claims are being handled by Simpluris.

When and how can I file a claim?

Attorney General Letitia James has worked with Southerntier to create a list of employees who may qualify. If you are on the list, you will receive a notice from Simpluris by mail, email, and text after December 23, 2025. 

Simpluris Inc., is managing the payments from the settlement fund. Simpluris will:

  • send notices to employees who are eligible for payment from the settlement fund
  • process payments to employees
  • answer questions about payments from the settlement fund

If you are eligible for a settlement payment, you will receive a notice with a claim form by mail, by email, or by text message. Your notice will have a unique claim ID and pin number.  You can fill out the claim form and mail or email it to Simpluris, or complete the claim process online:

  • The Simpluris settlement website will have a link to the claim form on the page.
  • Enter your claim ID number and pin, as instructed in your notice.
