Unions, organized labor

For employment issues related to a collective bargaining agreement, consult your union representatives. If you are a private-sector employee with a union-related question, contact the National Labor Relations Board. If you are a public-sector employee, contact the Public Employment Relations Board.

Pension or retirement benefits

For questions about private pensions or retirement plans, including your employer’s failure to provide the full amount of pension or retirement-plan benefits, contact the Employee Benefits Security Administration. If the employer is no longer in business, contact the Pension Benefit Guaranty Corporation. For executive and non-mayoral agencies in New York City, contact the NYC Inspector General. If you are a New York state employee, contact the Office of the New York State Comptroller.

Continuation of health insurance

For coverage questions about an employer with 20 or more employees, contact the U.S. Employee Benefits Security Administration. For an employer with fewer than 20 employees, contact the NYS Department of Financial Services.

Worksite health and safety precautions

New York’s laws and regulations protect workers:

  • Private-sector employees are protected during an outbreak of an airborne, infectious disease.
  • During a declared public-health emergency involving a communicable disease, public employers must have a plan for operating.

If your employer violates these laws and regulations, you have a right to file an anonymous complaint with the New York State Department of Labor (DOL).
