Executive Law Section 75(5)(b) Referrals

Under Executive Law section 75(5)(b), covered law enforcement agencies are required to refer to the Office of the New York State Attorney General (OAG) instances in which the agency has:

"receiv[ed] at least five complaints from five or more individuals relating to at least five separate instances involving a certain officer or employee within two years."

Upon receiving such a referral, OAG is required to:

"investigate [the] complaints to determine whether the subject officer or employee has engaged in a pattern or practice of misconduct, excessive force, or dishonesty."

The following table contains information related to 75(5)(b) referrals that LEMIO has closed to date.

  • Pattern of misconduct: After investigation, we concluded that the referred officer or employee engaged in a pattern or practice of misconduct, use of excessive force, or acts of dishonesty. To determine if there is a pattern, we assess whether the referred person engaged in multiple instances of similar misconduct. While the instances of misconduct must have some degree of similarity or commonality, they do not need to be identical, either with respect to the conduct or the law or policy that was violated.
  • No pattern: After investigation of the referred complaints, we did not find a pattern of misconduct.
  • No pattern; issue(s) noted: We did not find a pattern of misconduct, but noted one or more issues in the closing letter.
  • Administrative closure: The referral has been closed on an administrative basis because the referred person left the referring agency before the investigation concluded and is not actively serving in a law enforcement role with another covered agency.
