OAG Files Opposition to Trump’s Efforts to Obtain Emergency
Relief to Stop the Investigation into His Financial Dealings
NEW YORK – New York Attorney General Letitia James released the following statement on her office’s opposition to the motion for a preliminary injunction that Donald J. Trump filed on January 10, 2022 seeking an emergency order to stop the Attorney General’s investigation into his financial dealings. The opposition was filed this afternoon in the U.S. District Court for the Northern District of New York. Last week, Attorney General James filed a motion to dismiss Donald J. Trump’s lawsuit against her office’s investigation, arguing that the lawsuit is a baseless attempt to forum shop and should be dismissed on both procedural and substantive grounds. For these same reasons, and because Trump’s preliminary injunction filing did not include any supporting evidence, his motion for extraordinary emergency relief should be denied.
“For almost three years, the Trump Organization never questioned the legal authority or legitimacy of this investigation until Donald J. Trump himself was subpoenaed to testify. This is yet another baseless attempt to evade accountability. The only difference this time is that Mr. Trump is now threatening my office and calling on his supporters to act to stop this investigation. Not only is that deeply unethical, but it’s disturbing and dangerous, just like his calls to overturn an election which resulted in the January 6 attack on the U.S. Capitol. Despite these threats, we will not stop our investigation or our pursuit of justice because no one is above the law.”
